1. Subject matter and acceptance
These terms govern access to and use of the SaaS platform marketed under the SunnyTaz brand (hereinafter, the "Platform"), provided by the entity identified at the end of this document. By registering or using the Platform, you agree to be bound by these Terms and Conditions.
2. Nature of the service
The Platform is software as a service (SaaS) supporting document management, communication and automation of workflows related to the user's economic activity. The service is provided according to the contracted plan, current technical limits and features available at any given time.
3. Account and user obligations
The user is responsible for the accuracy of the data provided, the safekeeping of their credentials and all activity carried out from their account. The Platform must be used in compliance with applicable law and you must refrain from uses that could compromise the security, integrity or availability of the service.
4. Subscription, plans and limits
Access may be subject to subscription plans, usage quotas (for example, documents, tokens or AI features) and billing conditions published on the site or in the checkout flow. We reserve the right to modify plans provided that rights acquired during the current billing period are respected, unless otherwise required by law.
Non-payment or exceeding plan limits may result in temporary suspension or restriction of features until the situation is resolved.
5. Intellectual property
Software elements, design, trademarks and content proprietary to the Platform remain the property of Sunnyface or its licensors. The user is granted a limited, non-exclusive and non-transferable licence to use the Platform in accordance with these terms.
6. Limitation of liability
To the extent permitted by applicable law, liability for the service is limited to the amount paid by the user in the twelve (12) months preceding the event giving rise to the claim, except in cases of wilful misconduct or gross negligence. The Platform is offered "as is" and we do not guarantee the absence of interruptions or errors, although we strive to maintain reasonable levels of availability.
7. Amendments and termination
We may update these terms by notifying you through reasonable means (for example, a notice on the Platform or by email). Continued use after the stated period may imply acceptance of the new conditions. Either party may terminate the contractual relationship as provided for by law and under the specific conditions of the plan.
8. Applicable law and jurisdiction
Unless an overriding mandatory rule provides otherwise, disputes shall be subject to the law applicable in the Netherlands and to the competent courts under that law, without prejudice to the rights you may have as a consumer in your country of residence.
